My friend has left her ex-partner after a 9 year relationship. They have a
3yr. old son together and she has also a 10yr old daughter.
He
has been looking after their son for the past year as he was unable to work
after having an accident. The lack of his income forced my friend back into
full-time work after she had worked part-time.
My friend and her
daughter now live with me as she gets so much verbal abuse in their home
that it got unbearable. Her son is still with the dad as the son needs
care. He will start nursery (8am-6pm) on the 4th of January and my friend
wants him to live with her and his sibling.
Ideally she also
would like to go back into the family home, which is rented. The joint AST
will come to an end soon and he'll have to move out eventually.
Her expartner is threatening her with everything he can think of: taking
everything with him,not moving out,suicide etc. but most importantly to
fight her over the
residence of their
son.
Can someone please tell us where she stands legally with
him having been the main carer due to circumstances but with a change soon
when he starts nursery.
Her ex will have to find work soon as
his compensation money will be gone unless he wants to live on
benefits.
Will she
need to get a residence order? Will a court keep siblings together?
