Can anyone help me with this??

Hello my name is Josh im 25 years old and my fiance (22) was seeing another man for 3 month's before she decided to up and leave me and our 2 year old son from the home that we built together.As it stands now I have Physical custody and she has 50% visitation rights through a court order..She is currently living with the new boyfriend ,she still has no job , no Driver's License , No credit/bank account ,absolutely no means of supporting a child at this point. I recently received a summons to court because she now wants Physical custody of our child.So my question is.. is it legal for her to be living with a married man,when she was the primary reason for their divorce in the first place. Also whats the chances of her takin custody from me, when she is financially unstable and has no permanant/suitable living conditions for our son. Myself on the other hand- I own my home and i have a well payin job. If anyone can give me ANY advise or suggestions on this crazy perdiciment, i would be greatly appreciated.. Thanks

Hello - so sorry for your situation, but its great to hear you are so commited to taking care of your son. I'm guessing you are in the US, and I don't know about US law, also I think it is different in different states. Don't listen to anything your ex says. If you can afford it then get legal advice so that you know where you stand, also maybe there is a similar forum on the net which is US-­base­d where you could get local advice - but its fine for you to continue to post here. I hope things improve for you soon and you manage to get what you need for yuourself and your son.

It will be legal for her to be living with her partner despite their affair.That isn't illegal behaviour.
As for the custody of your kid you sound as if you have a much better case than her.All you can do is put forward your cases and the court will decide.
If you have already been awarded custody and her visitation.I wouldn't see why the court would change that decision.
