CAFCASS

In the Cafcass report where she sugegsts my son 12 sould only have supervised contact with dad and his side of the family is being challenged by X2B.
His main concern is why she did not choose to meet his side of the family which he claims is sons "second home"
she spoke to his parole officers over phone
met social services in regard to our case and met sons school teachers and then came to the decison. x2bs manner was controlling when she was home for meeting
how far does a cafcass report be challenged. can he force her to meet his family?

CAFCASS can only make recommendations, it is the judge who makes the decisions. Having said that CAFCASS is the "eyes and ears" of the court and there would need to be a good reason for a judge not to accept the conclusions and recommendations of the report. Good reasons would be if the report carried errors of fact or law.

A judge could decide that further investigation is required to assist him/her in making a decision, but in this case I think it's unlikely. Subjective evidence from family and friends tends not to carry as much weight as ­object­ive professional reports.

Its not a case of challenging the report, the report is used to help the judge so a judge makes a decision after being fully informed of the key issues.

You make your case to the judge as the other side do, the judge considers what the 9.5 guardian has to say and other professionals involved then decides what should happen.

The primary concern for the judge is to do what is in the best interest of the child, all other considerations are secondary to that.

well.. son 12 very adamant he wants to be with dad
CAFCASS and I have prooved that is not in his best interest and X2b has worked on him to say this because over two years he hates me..which was not the case before..
I have been in touch with schools, his doc, dentist etc and I am home ..which was confirmed in CAFCASS report
Nothing from his end which he is moaning abouot and wants the CAFCASS to meet his side of family..
I do not have much family in uk
x2b has conviction and been away from home for long in prison and caring for his dad
wonder what the outcome may be???
