Can I uase evidence from facebook for a court hearing?

I recently used it when someone made some threats. The police accepted the screenshot as evidence so I would say so.

I am thinking of using in children act matters - but there are some very offensive comments about the judge - I dont want to mud sling - just use the evidence that is pertinent to my case....

Thoughts please???

Yes, I used facebook chat and messages sent from my ex to our children - they were full of him pumping them for information about me and using very derogatory language. They were dynamite and i don't think I would have got the same decision had they not been used as evidence. This was for a shared residency application by my ex. It was not granted, and I have sole residence. He has since appealed this and again it has been denied.

can I pm you with some of the comments? In your case did it reduce contact time or just stop him obtaining joint res?

Yes by all means jess, and no it didnt reduce contact time as I was not seeking that, just that we did not have shared residency as he would take it as carte blanche to control me and the situation entirely. The order that the judge made specifically mentioned that neither of us were to discuss or speak detrimentally to the children about the divorce or eachother. Not that I had been doing but he had. At no point did anyone inc. the judge say that I had done anything wrong in using the f/b evidence. As they are minors I had a duty to protect them from this kind of emotional abuse.

I have used Facebook evidence to discredit the other party to great effect. I have pointed out that the evidence was taken from the public domain.
