great CAFCASS report, now Court on Monday

Brief history, ex wife stopped a 2 hour midweek contact, i took her to court for enforcement, judge ordered a CAFCASS report.

I got the report yesterday and it recommends that midweek contact is re instated and amended to overnight contact.

The recommendation is to collect Daughter from school on a Wednesday and return her to school on Thursday mornings.

Whilst i am chuffed to pieces, I can imagine the ex wife is currently spitting feathers.

I have court on Monday - will the Judge automatically authorise this recommendation or will I still have to "fight mine and my Daughters corner".

Im totally in agreement with the report but know that the ex hasnt achieved what she set out too, which was to reduce contact.

Do I need to prepare anything incase ex wife refuses for this recommendation to take place - can she actually do that??.

I have always thought that the CAFCASS report is 99% set in stone but also know that ex wife will do all she can, say all she can to stop this new contact happenining.

Any experience/advice would be really appreciated

That's excellent news. CAFCASS are the "eyes and ears" of the court so judges usually go with the recommendations unless good cause can be shown not to. The judges decision is final.

It's not automatic and your ex can contest it to a final hearing. However, as Fiona says, judges usually go with the recommendation and your ex would have to give an exceptionally good reason for the judge to depart from it.

A successful court appearance -

the judge re instated mid week contact and "ordered" ex wife to attend a Parenting Information Programme" because she refused to answer him when he asked her if she would be willing to attend

Judge did say that I would need to re apply to Courts if I wanted overnight contact as this wasnt in the original request.
