Re:can I insist on changing court date?

Hi...I'm a respondant in a contact issue, I have been to court about 6 times so far and for the last 4 I have stuck with the same barrister who is brilliant. My sol has just phoned to tell me that my usual barrister is not available for my next hearing (which was set back in novermber) and I'm to choose another barrister...I am not happy with this and told her to change the court date instead....this seems resonable to me as due to me ex and his sols hearing dates have been changed at least 4 times and often at the last minuet...do I have the right to insist on the courts settign another date so I can have the represtation I want...it's an important hearing

You don't have a right to insist but you could always ask. If it's an important hearing, the court may feel that it would be better to change the date.

Thanks for the reply Jonathan...not quite what I wanted to hear lol...this whole circus makes me feel like I've got no rights whatsoever!

I'm now thinking of not attending this hearing...I don't want a 'new barrister' getting involved at this stage who doesn't know all the ins and outs..who would just skim through the notes, not now the hearing as got to the stage it has, what would happen if I write to the judge and explain why I'm not attending...can I do that?

It just seems off that my ex and his sols have messed about with hearing dates all the way through this but I don't seem to have a say

PANIC OVER....IT WAS A MISTAKE, JUST HAD A CALL FROM MY SOL, I'M STILL HAVING MY USUAL BARRISTER *phew*

Well that's very good news because it really isn't a good idea not to turn up for court hearings without permission from the court. A judge could make an order in your absence or it could be held against you when it comes to making an order for costs.

thanks fiona..I'll bear that in mind if anything like this crops up again...I'm just so relieved.
