If the consent order goes to court, can either party use evidence to show the judge of deceptions and if so what is permissable?

ie dictaphone evidence of STBX stating financial ruin, is this legal if one party does not know of the recording, or is there a fail safe quote?

or photocopies of personal typed and handwritten notes or do you have to prove how you obtained them?

Just want to be covered when he threatens me (verbally).

You can ask the judge if they're happy to listen to it and the end decision is with them.

However under normal circumstances only the people involved in the conversation on the recording can legally hear it unless all parties are aware and give permission. Legislation does not prohibit conversations being recorded only who it can hear it.

Only exceptions are where someone is breaking the law such as grooming a child, planning a murder etc and had they known of the recording they obviously would change their behaviour. Family court cases involving children can allow them to be played. As this is purely a money case it would be up to the judge.

As T says, such matters are at the judges discretion which is wide...too wide in some respects!

Whilst this may sit well with those in the profession and those that were fortunate enough not to be abused (or aware they were being abused) by the legal profession...THERE ARE A FEW WHOM DI NOT ..oops caps...thge same can lead to alienation...ere are a few whom were abuswed by the legal profession...and to challenge same can lead to alienation....imho it is better to be alienated than suck up to textbook never been theres.
