Re:Applying for Ancillary Relief at a different court

My Ex and I had agreed a financial settlement when we decided to Divorce, so we went down the route of getting a Online Divorce + Consent Order done. He now doesn't want to agree to the terms of the Consent Order and it looks like I will need to apply to the Courts for a financial settlement. Because the Divorce was done at a court far away, it would be impracticle for both of us to attend court hearings for the Ancillary Relief proceedings. Therefore is it possible to apply for relief at a court nearby or can the case be transferred easily to another court. We have already got the Decree Absolute.

Ideally the proceedings should be transferred to your local court and the AR application issued. If you issue it at your local court then transfer the divorce suit, the documentation will keep going missing as there will be two case numbers.

It may also be the case that the court refuses to issue the application as there won't be any record of the divorce petition.

Another option is to issue the AR application at the current court and ask for it to be transferred immediately giving the reasons you have stated.

Not all courts operate the same procedures so it would be worth telephoning the current court and asking them the way forward. You may have to ask the question deveral times to several different people but you will get there in the end if you persevere.
