Can we be seperated and still live in the same house? but theres always a but.
The aim of Divorce is to show that the marriage has irrevicably broken down and the couple should no longer have to live together, and have the legal and financial ties that come with marriage. With todays high houseing costs and a looming recession it is not always pracitcal or even possable for one spouse to leave the marrital home in the begining, this raises the question can we divorce on the ground of seperation and live under the same roof?. In short the answer is yes. You can still be regarded as living separately whilst still living under the same roof as long as you both lead independent and separate lives, e.g. you no longer eat or sleep together and do not perform any domestic chores such as washing, ironing or cooking for one another. As soon as you are no longer living together you may be considered as separated. Separation for two or more years, providing both parties agree to the separation, can be the basis for divorce in the future It should also be noted that some District Judges are more strict than others when considering Petitions for seperation and the couple are still liveing in the marrital home.
