In this action the pursuer sought:- (1) decree of divorce; (2) an order for sale of the former matrimonial home; (3) a capital sum payable on the sale of the former matrimonial home; and (4) a periodical allowance.
It was submitted on behalf of the pursuer that this was an appropriate case for an ongoing periodical payment being made by the defender to the pursuer till her death or remarriage. It was accepted on behalf of the defender that there was need for an element of continuing support until the former matrimonial home was sold, after which the pursuer would gain a substantial capital sum which she could invest, and from which she would receive an income, thereafter there should be a clean break.
Order of a periodical allowance was made in favour of the pursuer at the rate of £2,000 per month for a period of three years from the date of decree, subject to an additional £500 per month until the former matrimonial home is sold; and after three years at the rate of £1,500 per month until the defender's retirement from paid employment.
