Hi, our current mortgage is in joint names and so are the title deeds. My husband and I are seperated and we have to apply for a new mortgage deal as our current one expires soon. He claims he can only find a mortgage deal in his name only. Can the finance be done in his name and the title deeds stay in joint names?

I dont know the answer but my instinct is be very very wary. Consult a solicitor and ask your question to the mortgage providers directly. I didnt trust my ex at all. We didnt need to change anything but I rang up the mortgage providers and told them I wanted it on record that I didnt trust my ex and if he tried anything dodgy I wanted it flagged up on the computer and this they did do. Whatever you do, you must keep your name on the title deeds, without that you have very little leeway. That way he cannot sell without your consent and he cant cheat you out of your share. But this question is really one for the professionals. Seek advice. |
